Open Data License

1. Acceptance and Grant of Licence

Your use of the data indicates your acceptance of OpenDOSM terms and conditions. If you fail to comply with the terms and conditions when using the data, your right to use the data will end automatically.

2. Freedoms

You are allowed to copy, publish, distribute, transmit, adapt and exploit the data commercially and non-commercially for example, by combining it with other data, or by including it in your own product or application.

3. Limitations

i. This Licence does not grant you any rights over:

a. any personal data in the dataset;

b. third party rights that the Agency is not authorised to license; and

c. patents, trademarks and design rights.

ii. You must not use the datasets in a way that suggests any official status or that an agency endorses you or your use of the datasets.

4. Intellectual Property

All datasets are the intellectual property of the Department of Statistics Malaysia (DOSM).

5. Termination of Licence

DOSM may terminate this Licence immediately upon your breach of any of the terms of this Licence. The Disclaimers and Indemnity sections, and any other provision of this Licence which is required to give effect to termination or the consequences of such termination, shall survive the termination of this Licence.

6. Exemptions

This Licence does not cover personal data in the information. Nor does it cover third party rights (including, but not limited to, patents, copyright, database rights or trademarks).

7. Governing Law and Jurisdiction

This Licence is governed by the laws of Malaysia and the parties to the Licence submit to the exclusive jurisdiction of the Malaysia courts.

8. Terms and Definitions

In this Licence, the terms below have the following meanings:

a. Data’ means information protected by copyright or by database right (for example, literary and artistic works, content, data and source code) offered for use under the terms of this licence.

b. ‘Department of Statistics Malaysia’ or ‘(DOSM)’ means the organisation providing the data under this licence.

c. ‘Use’ means doing any act which is restricted by copyright or database right, whether in the original medium or in any other medium, and includes without limitation distributing, copying, adapting, modifying as may be technically necessary to use it in a different mode or format.

d. ‘You’ and ‘your’ means the natural or legal person, or body of persons corporate or incorporate, acquiring rights in the data (whether the data is obtained directly from the Licensor or otherwise) under this licence.

9. Disclaimer

i. All data linked to OpenDOSM is published “as is”. The data is licensed ‘as is’ and DOSM and/or Licensor excludes all representations, warranties, obligations and liabilities in relation to the data to the maximum extent permitted by law.

ii. DOSM and/or Licensor are not liable for any errors or omissions in the data and shall not be liable for any loss, injury or damage of any kind caused by its use. DOSM does not guarantee the continued supply of the data.
